Kinds of business subject to authorization
There are special requirements and authorization procedures for many
kinds of business.
- Industry: the construction of plants with special influence
on the environment must be authorized according to the Federal Immission
Protection Law (“Bundes-Immisionsschutzgesetz”).
- Retail industry: for different branches, special evidence
of knowledge has to be proved (e.g. milk, pharmaceuticals).
- Hotel and catering industry: you need a licence which you
can receive from the Office of Trade (“Gewerbeamt”) after
a one-day-instruction at the competent Chamber of Commerce and Industry.
- Transport industry: the businesslike transport of persons
with buses, rental cars, and taxis is subject to authorization. The
concessions are granted by the competent Office of Trade respectively
by the Regional Board (“Regierungspräsidium”).
- Tourism: no permanent establishment; the competent Office
of Trade draws up the tourism card (“Reisegewerbskarte”).
- Freelancers: for the so-called “regular” freelancers
(e.g. attorneys, doctors, tax consultants), the settlement implies a
compulsory membership at the competent Chamber. For the so-called “irregular”
freelancers (e.g. artists, writers, scientists), no special authorization
is required.
There are also special regulations for a series of other industries (e.g.
the audit of personal and economic reliability by the Office of Trade):
- sales agents
- installers of automatic machines
- security services and auctions businesses
- gambling resorts
- pawnbrokers
- driving schools
- road haulage
Important note: beside these *standard
cases*, there are other circumstances which possibly entail a special
compulsory authorization. In order to check if your enterprise is subject
to authorization you should consult the Office
of Trade in any case.
