One-man Business (“Einzelunternehmung”)
The foundation of a one-man business is suitable as the first form of
small enterprises. The foundation formalities are very limited. You only
have to register the enterprise at the Office of Trade (“Gewerbeamt”).
The enterprise is led solely by its owner. He or she is personally liable
with his / her entire private means and business assets. The enterprise
does not have to be registered in the Register of Companies (but may well
be registered voluntarily). If the enterprise is not listed on the Register
of Companies, no detailed accounting is necessary; it will be enough to
have a simple revenue / surplus balance (“Einnahme-/Überschußrechnung”).
Note: the chance to lead your enterprise as a one-man business is limited.
As soon as your business activities get more wide-spread, you are subject
to lead your enterprise according to business principles (cf. > Register
of Companies > Legal
Consequences).
The advantages of this legal form are the uncomplicated foundation procedure,
the low demand of capital and the fact that you can decide on the fate
of your enterprise on your own.
